By accessing or using HeartMoments.in, you agree to the following Terms of Service.

1. Service Description

HeartMoments.in provides personalized digital experiences and interactive gifting products including proposal pages, birthday surprises, puzzles, digital cards, apology experiences, and other shareable content.

2. Digital Product Nature

All products sold on HeartMoments.in are digital products delivered electronically through generated links or online experiences.

No physical products are shipped.

3. User Responsibilities

You agree that:

• You will provide accurate information
• You own or have rights to uploaded photos/content
• You will not upload illegal, abusive, hateful, or copyrighted material
• You will not misuse or attempt to disrupt the platform

4. Payments

Payments are processed securely through Razorpay and supported payment partners.

Prices may change at any time without notice.

5. Refund Policy

Due to the personalized and digital nature of our services, completed/generated experiences are generally non-refundable.

Refunds may only be considered in cases of duplicate payments or technical delivery failures caused by our platform.

6. Intellectual Property

All branding, designs, animations, code, graphics, and platform content belong to HeartMoments.in unless otherwise stated.

7. Limitation of Liability

We are not liable for:

• User-generated content
• Relationship outcomes or emotional interpretations
• Third-party platform interruptions
• Temporary downtime or technical issues

8. Account Suspension

We reserve the right to restrict or terminate access to users violating these terms.

9. Buying Through a Reseller

Some surprises are sold by independent resellers through their own product links, storefronts or payment links. The surprise is still made, hosted and delivered by HeartMoments, and you pay HeartMoments directly through Razorpay.

A reseller may sell a surprise at their own price, which can be higher than the price on our website. The price you are charged is always the price shown on the page or payment link before you pay, including any coupon applied at checkout. A reseller’s coupon works only on that reseller’s sales, one code per order, and never takes the price below our own price.

Refunds follow our Refund Policy and are made by HeartMoments for the amount you actually paid. Resellers are not our employees or agents and may not make promises on our behalf; please report any misleading offer to us.

10. Terms for Resellers

Resellers must sell honestly: show customers the real price, do not claim false “was” prices or discounts, do not send spam, and do not pretend to be HeartMoments. Where a reseller sets their own price, they earn the difference between their price (after their own coupon) and our price instead of commission; this and any commission become withdrawable after the refund window and are reduced or reversed if the customer is refunded.

Reseller earnings are the reseller’s own income, and the reseller is responsible for any taxes on it. We may deduct tax at source where the law requires. We may change plans, rates and limits, and may suspend a reseller, disable their coupons or hold earnings while we check suspected abuse.

11. Changes to Terms

We may update these Terms at any time without prior notice.

12. Governing Law

These terms shall be governed by the laws of India.

Any disputes shall fall under the jurisdiction of courts located in India.
